- GENERAL PROVISIONS
- The Administrator of the personal data collected through the Internet Shop is MOOD NOOK with its registered office in Gdansk, Równa 19D Street, having NIP No.: 5842791217 and statistical REGON No.: 385514019, e-mail address: info@moodnook.com - hereinafter referred to as the “Administrator” and being at the same time the Internet Shop Service Provider and the Seller.
- Personal data of the Customer (Client) shall be processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended) and the Act on Provision of Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).
- The Administrator shall exercise particular care to protect the interests of data subjects, and in particular shall ensure that the data he collects are processed in accordance with the law; collected for specified, legitimate purposes and not subjected to further processing incompatible with those purposes; substantively correct and adequate in relation to the purposes for which they are processed; and stored in a form that allows the identification of data subjects for no longer than necessary to achieve the purpose of processing.
- All words, phrases and acronyms appearing on this site and beginning with a capital letter (e.g., Seller, Online Store, Electronic Service) shall be understood in accordance with their definition in the Terms and Conditions of the Online Store available in the Terms and Conditions section.
- PURPOSE AND SCOPE OF DATA COLLECTION
1.The purpose of collecting personal data by the Administrator is:
1.1.to establish, shape the content, change, execute or terminate the contractual relationship between the Service Provider (Seller) and the Service Recipient (Customer) consisting of the provision of Electronic Services through the Online Store or the conclusion and execution of a Sales Agreement for Products and their delivery to the Customer.
1.2. direct marketing of the Administrator's own products or services.
2.1. in the case of Customers who use Product delivery services to the Customer, the Administrator shall transfer the collected personal data of the Customers to the extent necessary for the delivery to the selected carrier:
2.1 Apaczka and DPD Polska Sp. z o.o. with its registered office in Warsaw (registered office address: 15 Mineralna Street, 02-274 Warsaw) number in the Register of Entrepreneurs of the National Court Register: 0000028368.
3. In the case of Customers who use electronic or credit card payments, the Administrator shall transfer the collected personal data of the Customers only to the intermediary selected by the Customer and only to the extent that is necessary for the Customer to make payments through them. The intermediary available on the Online Store is:
3.1. Dotpay S.A., based in Krakow, 30-552 Krakow, at Wielicka 72, registered by the District Court Krakow-Śródmieście in Krakow, XI Economic Department of the National Court Register under the number 0000296790, with Tax Identification Number 634-26-61-860, EU Tax Identification Number PL6342661860, REGON number 240770255.
4 The Administrator processes the following personal data of the Service Recipients (Customers): name and surname; e-mail address; contact telephone number; address (street, house number, apartment number, postal code, city, country). In the case of Service Recipients (Clients) who are not consumers, the Administrator additionally processes company name and tax identification number (NIP).
Provision of personal data referred to in item. 2.4. is necessary for the Service Provider to provide Electronic Services through the Online Store or to conclude a Sales Agreement for Products.
- COOKIES AND USAGE DATA
1. cookies are small text information in the form of text files, sent by the server and stored on the side of the user visiting the site of the Online Store (e.g. on the hard drive of your computer, laptop, or smartphone memory card - depending on what device you use when visiting our Online Store). 2.The Service Provider processes data contained in Cookies when visitors use the website of the Online Store for the following purposes:
2.1.identifying Service Recipients as logged in to the Online Store and showing that they are logged in;
2.2.remembering Products added to the shopping cart for the purpose of placing an Order;
2.3. remembering data from completed Order Forms, surveys or login data to the Online Store;
2.4. adjusting the content of the Internet Shop's website to the individual preferences of the Customer (e.g. concerning colors, font size, page layout) and optimizing the use of the Internet Shop's pages;
2.5. to conduct anonymous statistics showing the manner of use of the pages of the Internet Shop and to study the needs of the Service Recipients, excluding the personal identification of the Service Recipient.

- BASIS OF DATA PROCESSING
1.Provision of personal data by the Customer/Customer is voluntary, although failure to provide the personal data indicated in the Regulations necessary to conclude a Sales Agreement or an agreement for the provision of Electronic Services will result in the refusal to conclude such an agreement. The data necessary to conclude a Sales Agreement or an agreement for the provision of Electronic Services are also indicated each time on the website of the Online Store.
2.The basis for the processing of the Customer's/Customer's personal data is the need to perform the contract to which the Customer/Customer is a party or to take action at his/her request prior to its conclusion. In the case of data processing for direct marketing of the Administrator's own products or services, the basis for such processing is additionally the consent of the Customer/Client.
- THE RIGHT TO CONTROL, ACCESS AND CORRECT THE CONTENT OF YOUR DATA
(1) The recipient has the right to access the content of his personal data and to correct them.
(2) Each person shall have the right to control the processing of data concerning him/her contained in the Administrator's data filing system, and in particular the right to: request completion, updating, rectification of personal data, temporary or permanent suspension of their processing or deletion, if they are incomplete, outdated, untrue or have been collected in violation of the Act or are no longer necessary for the purpose for which they were collected.
(3) In the case of processing of data for the purpose of direct marketing of the Administrator's own products or services, the data subject shall also be entitled to lodge a written, reasoned request to stop the processing of his/her data due to his/her particular situation and to object to the processing of his/her data.
(4) In order to exercise the rights referred to above, the option can be used within the Account or by sending a relevant message by e-mail to: info@moodnook.com or in writing to the Administrator's address.
- FINAL PROVISIONS
1 The online store may contain links to other websites. The Administrator urges that when you go to other sites, you should read the privacy policy established there. This privacy policy applies only to this Online Store.
2.The Administrator shall apply technical and organizational measures to ensure the protection of the processed personal data appropriate to the risks and categories of data protected, and in particular shall protect the data from being made available to unauthorized persons, from being taken by an unauthorized person, from being processed in violation of applicable regulations, and from being altered, lost, damaged or destroyed.
3.The Service Provider shall provide the following technical measures to prevent acquisition and modification by unauthorized persons, personal data sent electronically:
