- without registration;
- by creating an account in the Shop.
In both cases, to place an order, select the Goods in the Shop, add them to the “Cart” using the appropriate button and continue the ordering procedure by selecting the relevant options (delivery and payment method).
- Product information in the Shop, i.e. descriptions and prices, constitutes an invitation to conclude a sales agreement within the meaning of Article 71 of the Civil Code, in accordance with the terms of the Terms and Conditions.
- A condition for placing an order is completing in the order form all the required data necessary to perform the agreement and, where applicable (at the customer's request), also the data needed to issue a VAT invoice.
- If the customer decides to create an account in the Shop (hereinafter the “Account”), registration is one-time, and the e-mail address and the password chosen by the customer are the basis for subsequent logging in. Details of the Seller's provision of the digital Account service are available below in the Account Terms. After logging in to the Account, the customer has access to their order history and does not need to fill in the order form with their personal data again for subsequent orders.
- Confirmation of the order by the customer with the “Order and pay” button (or another with equivalent wording) means:
- submitting to the Seller an offer to purchase the Goods in accordance with the options selected in the order and with these Terms and Conditions,
- acceptance of the obligation to pay the price of the Goods and the costs of their delivery.
- The sales agreement (hereinafter the “Agreement”) is concluded when the Seller accepts the order for fulfilment.
- The order is accepted for fulfilment when the Seller confirms the order. The order is deemed confirmed when payment has been made and the funds have been credited to the Seller's account. The customer receives confirmation of acceptance of the order in a confirmation e-mail. At that moment the Agreement is concluded.
- If it is not possible to fulfil the order for the Goods (in whole or in part), the Seller will inform the customer – in that case the Agreement is not concluded. At the same time, the Seller will inform the customer of the available alternative ways of fulfilling the order, e.g. partial fulfilment of the order or waiting for the Seller to replenish stock.
- If the order has been paid for by the customer but cannot be fulfilled, the Seller shall promptly refund the payments made to the customer (in proportion to the extent of the order cancellation).
- The Shop is not liable for non-delivery of the order or delays in its delivery resulting from the customer providing an incomplete / incorrect delivery address or failing to provide other data necessary to fulfil the order
- The Shop reserves the right to withdraw from fulfilling the order if the data provided by the customer in the order form are incomplete (missing first name, surname, address, e-mail address or telephone number), or if the data provided by the customer are incorrect.
- The order fulfilment time may change if confirmation or payment takes too long.
- The Buyer may make changes to the order until the Online Shop sends information that the order has been accepted for fulfilment. Changes can be made by telephone at +48 732-145-806 on weekdays from 10:00 to 16:00, excluding public holidays or by sending an e-mail to info@moodnook.com

-
PRICES AND PAYMENT METHODS
- Prices of the Goods are given in Polish zloty (PLN) as gross amounts, i.e. including VAT.
- The cost of delivery of the Goods is shown separately in the Shop's cart, depending on the delivery method chosen by the customer.
- The available payment methods are described on the Shop's website in the Payment methods tab and are presented to the customer when placing the order (in the cart).
- The Shop offers the following payment methods (the availability of individual methods may depend on the currency, the country of delivery or the order value; the current list is presented in the cart):
- traditional bank transfer to the Seller's account;
-
fast online transfer, BLIK, payment cards (Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro) and the digital wallets Google Pay and Apple Pay (depending on the device) – via the Shoper Płatności payment platform, operated by Autopay S.A.;
Where a refund is required for a transaction made with a payment card, the Seller makes the refund to the bank account linked to the Ordering Party's payment card.
- PayPal – including card payment via PayPal;
- Klarna – deferred payment or payment in instalments, on the terms set by Klarna;
- PayPo – deferred payment or payment in instalments, on the terms set by PayPo;
- InPost Pay – an InPost service that redirects the Customer to the InPost app to complete the purchase process, including making payment via the payment gateway.
- If the customer has chosen payment by ordinary bank transfer, payment for the order should be made within 7 days of placing it. If payment is not made within the above period, the Agreement is deemed not to have been concluded. The preceding sentence does not apply where the Seller offers customers deferred payment/payment in instalments through an external partner.
- If payment via Shoper Płatności is chosen, the entity providing online payment services for fast transfers, BLIK, payment cards, Google Pay and Apple Pay is Autopay S.A.
- The Shop reserves the right to change the prices of the Goods, modify the product range, introduce promotions and other price reductions. These changes will not affect sales agreements already concluded or the rights of customers taking advantage of a given promotion.
- The Seller may run a loyalty programme under which a customer with an Account receives points for purchases. Points collected in the Seller’s online shops – Skandynawskie Uchwyty (skandynawskieuchwyty.pl), Mood Nook (moodnook.com) and Viefe (viefe-shop.com) – are added together and may be used in any of these shops. The rules for awarding and using points, including their value, are made available by the Seller on the Shop’s website or in the customer’s Account. The Seller may suspend or end the loyalty programme; points collected before such a change are retained.

-
DELIVERY AND COLLECTION OF GOODS
- The Goods are delivered, at the customer's choice:
- by courier companies
- to InPost parcel lockers
- DPD Pickup
- If the customer chooses payment by bank transfer or payment card, the order fulfilment time is counted from the day the Seller's bank account or settlement account is credited.
- Except for Goods collected by the customer in person, the order is deemed fulfilled when the parcel is dispatched to the customer (handed over to the carrier). The exact actual delivery date is determined by the carrier.
- The Goods are dispatched by the Seller within 2 to 42 working days of acceptance of the order, unless a different time was clearly stated in the product description when the customer placed the order. Detailed fulfilment times are given on the Shop's website on the page of each Product.
- The customer receives confirmation of placing the order by e-mail immediately after placing it (clicking the “Order and pay” button or another with similar wording). In this message, the seller informs that the order has been accepted for fulfilment and of the expected fulfilment date.
- The Seller standardly handles orders within the territory of the Republic of Poland, at the costs indicated on the Shop's website: Delivery times and costs. Shipping abroad is possible to the countries available for selection in the cart, at the costs indicated on the Shop's website or at costs individually agreed with the customer.
- The Seller asks you to check the condition of the parcel on receipt, in particular whether it has been damaged or destroyed, and if it is damaged, to draw up a damage report with the courier. The report makes it easier and faster to process a complaint, but its absence does not exclude the customer's right to file a complaint. Please report damage noticed after receipt promptly, in accordance with the rules described in the Complaints section.
- The Goods are delivered, at the customer's choice:
-
INVOICING AND DELIVERY OF DOCUMENTS
- By placing an order and accepting the Shop's terms and conditions, the customer consents to the Shop issuing a personal invoice or a VAT invoice for the Goods.

- If the Online Shop cannot perform its obligation due to even a temporary impossibility of providing performance with the characteristics ordered by the buyer, it may release itself from the obligation by providing substitute performance of the same quality and purpose and at the same price, at the same time informing the consumer of their right to refuse this performance and to withdraw from the agreement, with the Goods being returned at the Online Shop's expense
- The purchased goods are accompanied by: proof of purchase, instructions for use and maintenance, product specification, instructions on the return rules.
- Goods in the "Promotions" section of the Online Shop's website are limited in quantity. Orders containing such products are fulfilled in the order in which confirmed orders for these goods are received, until stocks run out.
- In the event of an obvious error in the price or description of the Goods (e.g. a price significantly deviating from the market price), the Seller will inform the customer before dispatch and propose fulfilling the order at the correct price or cancelling it with a refund of all payments.
-
RIGHT TO WITHDRAW FROM THE SALES AGREEMENT
- Pursuant to Article 27 of the Consumer Rights Act, the Customer may withdraw from the sales agreement within 14 days of receiving the goods, without giving any reason, except in the cases specified below.
- A Customer who is an entrepreneur referred to in Article 7aa of the Consumer Rights Act (hereinafter the “Entrepreneur”) also has the statutory right to withdraw from the agreement for the sale of Goods within 14 days of receiving them, without giving any reason, subject to the exceptions referred to below.
- To meet the deadline for withdrawal from the agreement, it is sufficient for the customer to send, within the above period, a statement:
- Via the returns and complaints system available at: https://returns.xeper.io/login (recommended)
- Electronically to: info@moodnook.com
- In writing to: ul. Równa 19d, 80-067 Gdańsk
- The statement of withdrawal from the agreement may be submitted using the template available here, but use of the template is not mandatory. The Seller will promptly send the customer, by e-mail, confirmation of receipt of the statement of withdrawal from the agreement.
- Then, within a further 14 days, the customer should send the returned Goods at their own expense to the postal address: ul. Równa 19d, 80-067 Gdańsk.
- Promptly, and no later than within 14 days of receiving the statement of withdrawal from the agreement, the Seller shall refund to the customer:
- the price of the Goods;
- the costs of the original shipment of the Goods to the customer, according to the cheapest ordinary delivery method offered in the Shop.
- The Seller may withhold the refund until it receives the Goods back or at least until the customer provides the Seller with proof of having sent them back.
- The refund will be made using the same payment methods as those used by the customer in the original transaction, unless the customer has expressly agreed to a different solution.
- The customer may unpack the Goods and examine them to the extent necessary to establish their nature, characteristics and functioning. The Seller asks that the Goods not be installed or used before the withdrawal period expires. The returned Goods should be sent back complete and properly protected, preferably in the original packaging.
- The consumer is liable for any reduction in the value of the Goods resulting from using them beyond what is necessary to establish the nature, characteristics and functioning of the goods, unless the Seller has failed to inform the consumer of the right of withdrawal in accordance with the requirements of Article 12(1)(9) (the trader's information obligations).
- Returned Goods are sent at the buyer's risk.
- The costs of return shipment are borne by the customer, unless products reported as damaged are being sent.
- The Online Shop does not accept parcels sent back cash on delivery.
- The consumer is obliged to return the Goods to the Seller or hand them over to a person authorised by the trader to collect them promptly, but no later than 14 days from the day on which they withdrew from the agreement, unless the trader has offered to collect the goods itself. To meet the deadline, it is sufficient to send the goods back before it expires.
- If the agreement was concluded off-premises and the goods were delivered to the consumer at the place where they lived at the time the agreement was concluded, the trader is obliged to collect the goods at its own expense if, due to the nature of the goods, they cannot be sent back by post in the ordinary way.
- Please include in the statement of withdrawal the order number, the date it was placed and the date the Goods were received. This will help us process the return quickly.
- In the event of withdrawal from the agreement, the agreement is deemed not to have been concluded, and the parties return to each other what they have provided.
- The costs of shipping to the buyer are refunded only if the entire order is returned. If part of the order is returned, the cost of shipping to the buyer is not refunded.
- The definition of a consumer can be found in Article 221 of the Civil Code, and the definition of an entrepreneur in Article 431 of the Civil Code.
-
EXCEPTIONS TO THE RIGHT TO WITHDRAW FROM THE AGREEMENT FOR THE SALE OF GOODS

-
COMPLAINTS
- The Seller is obliged to deliver to the customer Goods that are in conformity with the Agreement.
- The Seller is liable for the conformity of the Goods with the agreement in accordance with the provisions of the Consumer Rights Act – towards consumers and entrepreneurs with consumer rights. Towards other customers, the Seller's liability is based on the rules arising from the Civil Code.
- The Seller is liable for any lack of conformity of the Goods with the agreement that existed at the time of delivery and became apparent within 2 years of that time. In the event of a lack of conformity, the consumer may demand repair or replacement of the Goods and, in the cases specified in the Consumer Rights Act, a price reduction or withdrawal from the agreement.
- Complaints may be submitted:
- via the returns and complaints system available at: https://returns.xeper.io/login (recommended),
- electronically to: info@moodnook.com
- or in writing to: ul. Równa 19d, 80-067 Gdańsk
- The Seller will consider the complaint within 14 days of receiving it and will inform the customer of its decision in the same form in which the complaint was submitted (in writing or by e-mail). Failure to respond within this period means that the complaint has been accepted.
- If dissatisfied with the way the Seller has handled the complaint, the consumer and the Entrepreneur may (regardless of ordinary proceedings before a common court) also use out-of-court complaint handling and redress procedures.
- For this purpose, you can:
- apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute,
- seek assistance from a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection,
- apply to a permanent consumer arbitration court with a request to settle a dispute arising from the agreement concluded.
- Additional information on out-of-court complaint handling and redress procedures can also be obtained on the website of the Office of Competition and Consumer Protection (UOKiK): https://polubowne.uokik.gov.pl/.
- Before sending the goods, the buyer should contact the Online Shop to agree on the date of sending the goods.
- The goods subject to the complaint should be sent in packaging that guarantees adequate protection during transport.
- The goods subject to the complaint should be accompanied by a description of the damage, stating when (in what situation) the defect occurs; the description should be as precise as possible.
- If the Goods subject to the complaint are needed to consider the complaint, the Seller collects them from the customer at its own expense and provides the customer with a shipping label. After the complaint has been considered, the Goods are sent back to the customer within 7 days at the Seller's expense. The Online Shop does not accept parcels sent cash on delivery.
