GENERAL PROVISIONS
- The service provider running the online store available at moodnook.com, hereinafter referred to as the “Online Store” or the “Store”, is MOOD NOOK, registered in the Central Register and Information on Business Activity of the Republic of Poland, maintained by the minister responsible for economic affairs, with its registered office in Gdansk, 19D Równa Street, having NIP number: 5842791217 and REGON statistical number: 385514019, hereinafter referred to as the “Seller”.
- The online store sells goods through the moodnook.com website.
- Before placing an order in the Store, the Customer is required to read these Regulations. Placing an order in the Store is tantamount to the Customer reading the Regulations and accepting their provisions as of the date of placing the order.

ORDER PLACEMENT AND EXECUTION
- The order is placed by the buyer in electronic form and constitutes an offer to conclude a contract of sale of the goods placed on the website of the Online Store for the price specified therein.
- The store reserves the right to withdraw from processing the order, if the data provided by the customer in the order form, are incomplete (no name, surname, address, e-mail address or telephone number), or if the data provided by the customer is incorrect.
- The order is accepted for processing when the Seller confirms the order. The order is considered confirmed when the money is paid and credited to the Seller's account. The customer receives confirmation of order acceptance in the confirmation e-mail. At that moment the contract of sale is concluded.
- The delivery date of the order is subject to change if it takes too long to confirm or pay.
- The buyer can make changes to the order until the Online Store sends information about accepting the order for processing. Making changes is possible by calling +48 818 847 171 or sending an e-mail to info@moodnook.com.
- Information about the availability of goods is displayed next to each product.
- The shipping time of the order is calculated in business days.

RIGHT OF WITHDRAWAL FROM THE SALES CONTRACT
- Buyer - a consumer who has entered into a contract of sale with the Online Store, may withdraw from it without giving reasons, making a statement to that effect in writing within 14 days from the date of delivery of the purchased goods. Within 30 days of purchase, we allow you to exchange the goods for another from our offer.
- The statement of withdrawal should include, in particular, the order number, the date of its submission, the date of receipt of the goods, an indication of the form of refund of the price paid.
- In the event of withdrawal from the contract, the contract is considered not concluded. What the parties have provided shall be returned unchanged.
- The return should be made - at the expense of the buyer - immediately, no later than within fourteen days. Cash on delivery shipments will not be accepted by the Online Store.
- Shipping costs to the buyer are refundable only if the entire order is returned. If part of the order is returned, the cost of shipping to the buyer is not refundable. Refunds are made by wire transfer to the account specified by the buyer.

METHODS OF PAYMENT

The buyer can choose the following forms of payment:

If there is a need for a refund for a customer's payment card transaction, the seller will make the refund to the bank account assigned to the customer's payment card.
- Transfer to bank account
A form of payment for customers who prefer to log in to an online bank by themselves, visit a bank branch or post office. After reserving the ordered goods, the customer receives by email the bank account number to which the correct amount should be transferred. As soon as the payment is credited to the bank account, the order is transferred to the warehouse for shipment preparation.

If you choose payment by bank transfer to your account, the goods will be shipped only after the payment of the full amount for the ordered product plus shipping costs due is credited to the Store's bank account.
- Internet payments/e-transfer: Autopay, Dotpay, PayPal, PayU, Przelew24
- Settlement of credit card transactions: are carried out through Dotpay, PayPal and PayU
Orders that are not paid within a week from the date of their placement will be canceled, after sending an inquiry as to their validity (by e-mail).

TERMS AND CONDITIONS FOR DELIVERY OF GOODS
- If the customer chooses to pay by bank transfer or credit card, the order processing time is calculated from the date of crediting the Seller's bank account or checking account.
- The ordered goods are delivered to the buyer by DPD courier service.
- The buyer should pay due attention to the condition of the shipment upon receipt, in particular whether the shipment has not been damaged or destroyed.
- The store is not responsible for delays in delivery by courier companies. Complaints about mechanical damage to the shipment, occurring during transport, will be considered only after the preparation of a damage protocol signed by the recipient and the provider of the shipment.
- Current shipping prices are listed on the moodnook.com store website in the Delivery section. For shipments weighing more than 5 kg and shipments outside the borders of the Republic of Poland, the cost of shipping is agreed individually.

OTHER RIGHTS AND OBLIGATIONS OF THE PARTIES TO THE SALES CONTRACT
- If the Online Store is unable to perform due to the fact that the goods ordered by the buyer are not available - it should immediately, but within thirty days from the conclusion of the contract at the latest, notify the consumer of this fact and return the entire amount of money received from him.
- In the event that the Online Store cannot fulfill the obligation due to even a temporary inability to fulfill the performance of the properties ordered by the buyer - it may discharge the obligation by providing a substitute performance, corresponding to the same quality and purpose and for the same price, while informing the consumer of his right not to accept this performance and withdraw from the contract, with the return of the item at the expense of the Online Store.
- The purchased goods are accompanied by a proof of purchase, instructions for use and maintenance, product specifications.
- Goods in the “Promotions” section of the Online Store's website are limited in quantity. Fulfillment of orders containing such products is carried out in the order of receipt of confirmed orders for these goods, until stocks are exhausted.

COMPLAINT PROCEDURE
- The complaint should be submitted in writing.
- Before sending the goods, the buyer should contact the Online Store to determine the date of shipment of the goods.
- Complained goods should be sent in packaging that must guarantee adequate protection during transport.
- The advertised goods should be accompanied by a description of the damage, including the situation when (in which situation) the defect occurs; such description should be as accurate as possible.
- Shipping and insurance costs of the advertised goods shall be borne by the buyer. The Online Store does not accept parcels sent back cash on delivery.
- The Internet store will inform the buyer about accepting or rejecting the complaint within 14 days from receiving the complaint package.
- Complained goods are sent back to the buyer within 7 days after considering the complaint. If the complaint is accepted, the shipping cost is paid by the Online Store. If the complaint is not accepted, the shipping cost is paid by the buyer.

PRINCIPLES OF PERSONAL DATA PROTECTION
- Buyer - a natural person at the time of placing an order agrees to the processing of his personal data by the Online Store, in accordance with applicable regulations, in particular the Personal Data Protection Act and the Act on Providing Electronic Services.
- The personal data provided is processed by the Online Store exclusively for the proper execution of the sales contract.
- FINAL PROVISIONS
- The Regulations shall come into force on 18.08.2014
- The online store has the right to change the Terms and Conditions. Amendments to the Terms and Conditions become effective on the date the amended Terms and Conditions are posted on moodnook.com
- In matters not covered by the above Regulations, the relevant provisions of the Civil Code shall apply.
- These Terms and Conditions are made available to buyers free of charge via moodnook.com in a form that makes it possible to download, record and print them.
